Question
auto accident.rear ended while stopped in traffic.Taken by ambulance to ER. 10 hours in ER.diagnosed with cervical and lumbar strain, also urinary retention with foley catheter for 5 days.then another ER,told Dr of numbness and tingling in my fingers. Dr said probably hit my elbow. Then instructed on home catherization 3 times a day for 7 days. That is 12 days after accident.18 days after accident started physical therapy. about 26 days after accident started to lose use of my left arm and hand, severe pain with tingling and numbness in fingers.diagnosed as brachial plexopathy.Question? insurance co IME says that the 26 day hiatus between accident and symptoms of plexopathy is too much time.Symptoms should have been immediate.I have 2 IMEs that say that is not true.Symptoms were immediate at the ER with cervical and lumbar strain.no history of this in my prior medical record.Would this be considered a hiatus? or could it be immediate signs of plexopathy? Insurance co will only take their IME.

Answer
Billjan,
That is absolutely not true. You had numbness in your hands while in the hospital, it has progressively
gotten worse ove a few weeks. They are saying that because they are trying to get out of paying your bills. Get a lawyer that specializes in personal injury. If you live in Ny and need a name let
me know.
